<![CDATA[ <![CDATA[On August 2, 2012 Congresswoman Kathy Hochul introduced a bill in the U.S. House of Representatives seeking to amend the Computer Fraud and Abuse Act (18 U.S.C. 1030) and the federal identity theft statute (18 U.S.C. 1028), among other statutes. Congresswoman Hochul seeks to add sentencing enhancements of up to ten years in prison if the criminal activity harms persons 65 years or older. The proposed amendments have no mens rea requirement, so presumably even unknowing harm by a defendant of a person 65 years or older would trigger the sentencing enhancement.
